These Terms & Conditions (the “Terms”) govern your access to and use of the cookieray.com website, the CookieRay WordPress plugin, and CookieRay Pro (collectively, the “Services”), all provided by DevItems LLC (“DevItems,” “CookieRay,” “we,” “us,” or “our”). Please read them carefully.

1. Acceptance of Terms

By accessing the Website, installing or using the CookieRay plugin, or purchasing CookieRay Pro, you agree to be bound by these Terms. If you do not agree, do not use the Services.

2. License

Free plugin (GPLv2). The free CookieRay plugin distributed on WordPress.org is licensed under the GNU General Public License, version 2 or later (GPLv2). Your use of the free plugin is governed by the terms of that license.

CookieRay Pro. CookieRay Pro is provided under a paid license tied to your purchase. While the Pro software code remains subject to the GPL, your subscription grants you access to automatic updates, Pro features, and support for the licensed number of sites and the duration of your active subscription. License keys may not be shared, resold, or redistributed for the purpose of circumventing the subscription.

3. Permitted Use

You agree not to:

  • Use the Services in violation of any applicable law or regulation;
  • Attempt to gain unauthorized access to our systems, the Website, or other users’ accounts or license keys;
  • Interfere with or disrupt the integrity or performance of the Services;
  • Misrepresent your identity or your authority to bind any organization to these Terms.

4. Intellectual Property

The CookieRay name, logo, branding, website content, and documentation are owned by DevItems LLC and protected by applicable intellectual property laws, except where licensed under the GPL or otherwise noted. Nothing in these Terms transfers ownership of our trademarks or brand assets to you.

5. Disclaimers

Provided “as is.” The Services are provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

Not legal advice. CookieRay is a software tool, not a law firm. Nothing provided through the Services constitutes legal advice. We do not guarantee that using CookieRay will make your website compliant with the GDPR, ePrivacy Directive, CCPA/CPRA, or any other law or regulation. Compliance depends on how you configure and use the plugin, the specifics of your website, and your own legal obligations. You are responsible for ensuring your website meets all applicable requirements, and you should consult qualified legal counsel.

6. Limitation of Liability

To the maximum extent permitted by law, DevItems LLC and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, goodwill, or other intangible losses, arising out of or related to your use of (or inability to use) the Services. Our total aggregate liability for any claim relating to the Services will not exceed the amount you paid us, if any, in the twelve (12) months preceding the claim.

7. Pro Subscriptions & Billing

CookieRay Pro is offered on a subscription basis. By purchasing a subscription, you authorize us and our payment provider to charge the applicable fees, including automatic renewals, to your payment method until you cancel. Prices and plans may change; we will give reasonable notice of changes affecting active subscriptions. You may cancel at any time, and cancellation takes effect at the end of your current billing period. Refunds are governed by our Refund Policy.

8. Termination

We may suspend or terminate your access to the Services, including Pro features and support, if you breach these Terms or use the Services unlawfully. Upon termination, your right to use Pro features and receive updates and support ends. The free plugin remains subject to the GPL.

9. Governing Law

These Terms are governed by the laws of the jurisdiction in which DevItems LLC is organized, without regard to its conflict-of-laws principles. You agree to the exclusive jurisdiction of the courts located in that jurisdiction for any dispute arising from these Terms or the Services.

10. Changes to These Terms

We may revise these Terms from time to time. When we do, we will update the “Last updated” date above. Your continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
